Germany Calls on Kosova Politicians to Respect Constitutional Court Ruling

The German Embassy in Kosova told Radio Free Europe that all political forces must fully respect and implement the Constitutional Court’s ruling on forming the new parliament after February elections. Moreover, Berlin warned of consequences if the ruling is ignored.

“Politicians must act urgently to end this six-month-long crisis. Therefore, we expect a quick resolution within the court’s timeframe. Furthermore, we urge all political stakeholders to work toward a compromise. Otherwise, failing to respect the ruling threatens citizens’ welfare and Kosova’s EU path,” the embassy said.

The Constitutional Court published its ruling on August 8. Accordingly, deputies must form the new parliament within 30 days. Then, the new speaker must be elected by open vote. The 30-day period begins when the full ruling appears in the Official Gazette, which has not happened yet.

The embassy’s message came while Michael Reiffenstuel, Germany’s Western Balkans director, met political and state leaders. He also urged them to respect the court’s decision. Reiffenstuel met President Vjosa Osmani, acting Prime Minister Albin Kurti, PDK leader Memli Krasniqi, LDK leader Lumir Abdixhiku, Kosovo Serb party representatives, and civil society members.

Similarly, the European Union, the U.S., and Italy called on parties to respect the court. On one hand, PDK, LDK, and AAK welcomed the ruling. On the other hand, Lëvizja Vetëvendosje (LVV), the election winner, criticized it. LVV described the ruling as arbitrary and claimed it deviates dangerously from constitutional principles and the separation of powers.

Meanwhile, the full ruling will allow the inaugural session of parliament and clarify what happens if deputies ignore the 30-day deadline. Previously, the court had not specified consequences for noncompliance.

The political deadlock arose because no party won a majority in February. Consequently, LVV holds 48 seats. Meanwhile, other parties refused to elect its candidate for speaker, who needed at least 61 votes. Under the new ruling, LVV can present a speaker candidate for a vote only three times.

Election results: PDK second with 24 seats, LDK third with 20. The Serbian List holds 9 seats. AAK-Nisma coalition holds 8. Additionally, eleven seats belong to other minorities.
