Foreign Investment Screening: AmCham Calls for a Clear Law for Investors

The draft decision of the Council of Ministers on foreign investment screening has drawn strong attention from the American Chamber of Commerce (AmCham).

The draft sets rules for assessing foreign direct investments. It focuses on projects that affect critical public infrastructure, key technologies, dual-use goods, critical supplies, access to sensitive information, and media freedom.

AmCham said the proposal aims to screen investments in strategic sectors to protect national security. The chamber considers the issue very important. Its main mission is to promote foreign investment, especially from the United States.

AmCham agrees on the need for a screening mechanism. However, it stresses that Albania must create it through a clear and comprehensive law. The law should protect national security. It should also give investors clarity and predictability about the criteria they must meet.

According to AmCham, Albania needs a special law, not only a secondary regulation. This step would align the legal framework with European Union legislation. It would also ensure a balanced and proportional application of the screening system.

AmCham says Albania can protect national security while attracting foreign capital. A strong legal framework can guarantee security. It can also increase investor accountability for the source of funds. At the same time, it can support investment through transparency and legal certainty.
