EU court adviser backs legality of Italy–Albania migrant protocol under EU rules

TIRANA, April 24 – The Advocate General of the Court of Justice of the European Union has said the Italy–Albania migration protocol is compatible with EU asylum and return rules, according to an opinion issued ahead of a final ruling.

The protocol, signed on 6 November 2023 by the prime ministers of Italy and Albania, allows Italy to establish and operate migrant detention and repatriation centres in Albania under Italian jurisdiction.

Nicholas Emiliou said EU law does not prevent a member state from setting up migration processing centres outside its territory. He stressed that authorities must fully respect safeguards, including legal assistance, interpretation services and access to family contact.

The opinion also highlighted special attention for minors and vulnerable individuals. A final judgment from the EU Court of Justice is expected in the coming months.
